These terms govern your access to and use of THE PIVOTAL PROTOCOL Academy. Read them in full before creating an account or subscribing. By using the platform, you accept these terms.
These Terms of Service form a binding agreement between you (the "User," "you," or "your") and THE PIVOTAL PROTOCOL (the "Company," "we," "us," or "our") regarding your access to and use of the Academy platform, including all websites, member areas, downloadable materials, embedded video, software interfaces, and related services we provide (collectively, the "Service").
By creating an account, completing checkout, accessing course material, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service together with our Privacy Policy, Educational Disclaimer, Acceptable Use Policy, and any additional posted policies (collectively, the "Agreement").
If you do not agree to any part of the Agreement, you may not use the Service. Continued use after revisions to these terms constitutes acceptance of the revised terms.
You represent that you are at least eighteen years of age and have the legal capacity to enter into this Agreement. The Service is not directed to or intended for use by individuals under eighteen.
Access to most areas of the Academy requires an account. When you register, you agree to:
We reserve the right to suspend, lock, or terminate any account that we have reason to believe has been shared, sold, transferred, or compromised, or that has been used to violate these Terms or our Acceptable Use Policy.
We may require multi-factor authentication, device verification, or similar security measures. You agree to cooperate with these measures and acknowledge that they exist for your protection and the integrity of the Service.
The Academy is offered on a recurring subscription basis. Pricing, billing intervals, and the features included in each tier are presented at the point of sale and are subject to change with notice.
All payments are processed by Stripe, a third-party payment processor. We do not store your full payment card details on our servers. By submitting payment information, you authorize Stripe to charge the payment method you provide for the subscription you select.
Subscriptions renew automatically at the end of each billing cycle at the then-current rate for your tier, until you cancel. You authorize us, through Stripe, to charge your payment method on each renewal date without further action by you.
We may change subscription pricing at any time. Price changes apply to renewals occurring at least thirty days after notice is sent to the email address associated with your account. If you do not wish to renew at the new rate, you may cancel before the next renewal date.
If a renewal payment fails, we may retry the charge, suspend access until payment is successful, or terminate the subscription. You remain responsible for any unpaid amounts.
Listed prices do not include applicable sales, use, value-added, or similar taxes, which may be added at checkout based on your billing address.
You may cancel your subscription at any time from your account billing page or by contacting support. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.

All references to peptides, hormones, supplements, training methods, fasting protocols, sleep interventions, and related topics are presented for educational and academic-reference purposes only. Inclusion of a compound, dose range, citation, or framework in any module, article, video, document, calculator, or downloadable file does not constitute a recommendation that any person use that compound or follow that protocol.
You agree that you will not interpret any portion of the Service as medical advice and will consult a licensed physician before making any decision involving your health, supplementation, training, fasting, or use of any peptide or pharmaceutical compound.

The Service may allow you to create, store, or share content such as private notes, bookmarked lessons, custom protocol drafts, calculator inputs, lab tracking entries, journal logs, and community posts ("User Content").
You retain ownership of your User Content. You grant us a limited, worldwide, royalty-free license to host, store, back up, transmit, and display your User Content solely as necessary to operate the Service for you. We do not claim ownership over your private notes or protocol drafts.
For any User Content you choose to make public (community posts, shared protocols), you grant us and other Service users a non-exclusive, royalty-free license to view, share within the Service, and reasonably engage with that content for its intended purpose.
You represent that your User Content does not infringe any third-party rights, does not violate applicable law, and does not contain protected health information of any other person without that person's authorization.
We may remove User Content that violates these terms, our Acceptable Use Policy, or applicable law. We have no obligation to monitor User Content but reserve the right to do so.
All course content, video lessons, written articles, frameworks, methodologies, calculators, downloadable PDFs, slide decks, illustrations, brand marks, logos, color systems, typography, copy, and code that compose the Service are the intellectual property of THE PIVOTAL PROTOCOL or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the content for your own educational purposes. No other rights are granted.
You may not, without our prior written authorization:

Our collection, use, and protection of your personal data are governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please read it carefully.
You may terminate your account at any time through your billing page or by contacting support. Upon termination, your access to paid features ends at the close of your current billing period.
We may suspend or terminate your account, with or without notice, if we determine in our reasonable judgment that you have violated this Agreement, our Acceptable Use Policy, or applicable law, or if continued provision of the Service would expose the Company or other users to legal, security, or operational risk.
Upon termination for cause, no refund is owed for any prepaid subscription period.
Sections that by their nature should survive termination, including intellectual property, limitation of liability, indemnification, governing law, and any payment obligations accrued prior to termination, will survive.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, THE PIVOTAL PROTOCOL disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
To the fullest extent permitted by law, in no event will THE PIVOTAL PROTOCOL, its members, officers, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, or personal injury, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or related to this Agreement or the Service will not exceed the greater of one hundred United States dollars or the total amount you paid us in the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless THE PIVOTAL PROTOCOL and its members, officers, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
This Agreement is governed by and construed in accordance with the laws of the United States and the state in which THE PIVOTAL PROTOCOL is principally organized (state to be confirmed in a future revision), without regard to conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or relating to this Agreement or the Service will be resolved exclusively through binding arbitration administered under the rules of a recognized arbitration body, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
You agree that any dispute will be resolved on an individual basis and not as a class, collective, consolidated, or representative action. You waive any right to a jury trial and to participate in a class action.
